Kiralama s\u00fcrecinde ya\u015fanabilecek sorunlar\u0131n \u00f6n\u00fcne ge\u00e7mek i\u00e7in ev sahibi ve kirac\u0131lar\u0131n haklar\u0131n\u0131n netle\u015ftirilmesi \u00f6nem ta\u015f\u0131maktad\u0131r. T\u00fcrkiye\u2019de ev sahibi ve kirac\u0131lar\u0131n haklar\u0131 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu ile koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu kanunda belirtilene g\u00f6re kirac\u0131lar\u0131n kira \u00fccreti \u00f6demek d\u0131\u015f\u0131nda ev sahibine kar\u015f\u0131 sorumluluklar\u0131 mevcuttur. Ayn\u0131 \u015fekilde ev sahibinin de kirac\u0131s\u0131na kar\u015f\u0131 sorumluluklar\u0131 mevcuttur.<\/p>\n\n\n\n

-Ev sahibinin kira s\u00f6zle\u015fmesinde belirtilen s\u00fcre i\u00e7inde kirac\u0131s\u0131n\u0131 evden \u00e7\u0131karma hakk\u0131 bulunmaz. S\u00f6zle\u015fmede belirtilen kira s\u00fcresinden bir ay \u00f6nce ev sahibi kirac\u0131ya ihtarname g\u00f6ndermez ise s\u00f6zle\u015fme otomatik olarak yenilenir ve kira s\u00f6zle\u015fmesi s\u00fcresiz bir kontrata d\u00f6n\u00fc\u015f\u00fcr.
-Ev sahibinin \u00fcst veya altsoyundan bireylerin s\u00f6z konusu evde oturmas\u0131 durumunda mevcut kirac\u0131 s\u00f6zle\u015fmeye bak\u0131lmaks\u0131z\u0131n evden \u00e7\u0131kar\u0131labilir.
-Kirac\u0131 evden verim alamazsa yani ya\u015fam kalitesini d\u00fc\u015f\u00fcrecek sorunlar mevcutsa yine kontrata bak\u0131lmaks\u0131z\u0131n evden ayr\u0131l\u0131p kiray\u0131 sonland\u0131rabilir.
-Ev sahibi, kira bedelinin \u00f6denmemesi durumunda s\u00f6zle\u015fmeyi feshetme hakk\u0131na sahiptir. Ancak ihtarname g\u00f6nderilerek bu bedelin 30 g\u00fcn i\u00e7inde \u00f6denmesini isteyebilir.
-S\u00f6z konusu dairede kirac\u0131 ev sahibinden eve tadilat yapmas\u0131n\u0131 isteyebilir. Evin tadilat\u0131 ev sahibinin sorumlulu\u011fundad\u0131r. Tadilat\u0131 direkt ev sahibi yapabilir ya da kirac\u0131dan yapt\u0131rmas\u0131n\u0131 isteyip kira \u00fccretinden d\u00fc\u015ferek \u00f6deyebilir.
-Evin kusurlar\u0131n\u0131n giderilmesi konusunda acele etmek gerekmezse ev sahibinden kira indirimi talep edilebilir.
-Kirac\u0131n\u0131n, s\u00f6z konusu m\u00fclk\u00fc (ev veya i\u015fyeri) ba\u015fka bir ki\u015fiye kiralama hakk\u0131 vard\u0131r. M\u00fclke zarar vermemek \u015fart\u0131yla k\u0131smen ya da tamamen devredebilir.
-M\u00fclk\u00fcn temel b\u00f6l\u00fcmleri ve demirba\u015flar\u0131n kullan\u0131lamayacak durumda yenilenmesi ev sahibinin sorumlulu\u011fundad\u0131r. Ancak kirac\u0131 bunlar\u0131 zevkine g\u00f6re de\u011fi\u015ftirmek isterse do\u011facak olan \u00fccretten kirac\u0131 sorumludur.
-Ev sahibi \u00f6nceden kirac\u0131s\u0131n\u0131 bilgilendirmek \u015fart\u0131yla evi bir ba\u015fkas\u0131na satabilir. Evin sat\u0131\u015f\u0131 ger\u00e7ekle\u015firse ev sahibi ihtarname g\u00f6ndererek kirac\u0131y\u0131 alt\u0131 ay i\u00e7inde evden \u00e7\u0131karabilir.
-Ev sahibi m\u00fclk\u00fcn\u00fc zamanla olu\u015fan y\u0131pranmalar d\u0131\u015f\u0131nda verdi\u011fi gibi teslim alma hakk\u0131na sahiptir. Kirac\u0131n\u0131n ev sahibinden izinsiz olarak yap\u0131lan tadilat ve de\u011fi\u015fiklikleri geri almas\u0131n\u0131 isteyebilir.
-M\u00fclke ait sigorta ve vergi gibi \u00f6demeleri ev sahibi kar\u015f\u0131lar.
-Zaman\u0131nda \u00f6denmeyen kiralar varsa bunlar i\u00e7in daha sonraki d\u00f6nemlerde ev sahibinin ek \u00fccret talebi kabul edilmez.
-Ev sahibi kirac\u0131dan 3 kira bedelinde depozito isteyebilme hakk\u0131na sahiptir. Kontrat bitiminde kirac\u0131 evden ayr\u0131l\u0131rken eve zarar verdi\u011fi tespit edilirse bu depozito bedeli zararlar\u0131 gidermek i\u00e7in kullan\u0131l\u0131r ve kirac\u0131ya iade edilmez. Ancak zarar s\u00f6z konusu de\u011filse kirac\u0131 depozitosunu geri alma hakk\u0131na sahiptir.<\/p>\n\n\n\n
